Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") govern access to and use of MilikiHub (the "Service"), a school management platform for schools in Kenya. By creating an account, subscribing to a plan, or otherwise using the Service, you agree to these Terms. If you are accepting these Terms on behalf of a school, you confirm you have the authority to do so, and "you" refers to that school.
2. The Service
MilikiHub provides tools for schools to manage homework, attendance, fees, safety alerts, and communication between schools, teachers, parents, and students. Features and pricing may change over time; we'll make reasonable efforts to notify subscribing schools of material changes.
3. Accounts
School administrators create the school's account and are responsible for creating and managing teacher, parent, and student accounts within it, and for the accuracy of information entered. You are responsible for keeping login credentials confidential and for all activity under your account. Notify us promptly at support@milikihub.com if you suspect unauthorized access.
4. School Responsibilities for Student Data
As between MilikiHub and the school, the school is responsible for having a lawful basis to collect and enter student, parent, and teacher data into the Service, for obtaining any required parental consent, and for only entering data necessary for school administration. MilikiHub processes this data as instructed by the school, as described in our Privacy Policy.
5. School Fees Are Not Processed Through MilikiHub
MilikiHub is a record-keeping tool for school fees, not a payment processor. Parents pay school fees directly to the school by whatever method the school arranges (such as M-Pesa); that money never passes through MilikiHub. Schools may use the Service to record fee structures and log confirmation references (such as an M-Pesa transaction code) submitted by parents. MilikiHub stores that information as entered but does not verify, guarantee, process, receive, or hold any of the underlying funds, and is not responsible for payment disputes, misreported references, or reconciliation errors between a school and a parent. Schools remain solely responsible for confirming and reconciling fee payments with their parents.
6. Subscription and Billing
Separately from Section 5, schools pay MilikiHub a subscription fee to use the platform itself, billed according to the plan selected at sign-up and processed through our third-party payment gateway, IntaSend. Fees are charged in advance for the applicable billing period unless otherwise agreed. Prices, coupons, and promotional discounts may change; changes will not apply retroactively to an active billing period. Refunds are considered on a case-by-case basis — contact support@milikihub.com to request one. Non-payment may result in suspension of access to paid features until the account is brought current.
7. Acceptable Use
You agree not to use the Service for any unlawful purpose; upload or transmit content that is defamatory, abusive, or infringes another's rights; attempt to gain unauthorized access to the Service or other users' data; interfere with or disrupt the Service's operation; or use the Service to send unsolicited communications. We may suspend or terminate accounts that violate these Terms.
8. Safety Alerts
The Service allows schools to send safety alerts and notices to parents. MilikiHub is a communication tool, not an emergency response service. In an emergency, schools and parents should also contact local emergency services directly.
9. Intellectual Property
MilikiHub and its original content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws. Data you or your school enter into the Service remains yours; we don't claim ownership of it, and use it only to provide the Service as described in our Privacy Policy.
10. Service Availability
We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may perform maintenance, and features may change or be discontinued with reasonable notice where practical.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. In particular, MilikiHub makes no warranty regarding the accuracy of fee payment records, which are self-reported by schools as described in Section 5.
12. Limitation of Liability
To the fullest extent permitted by law, MilikiHub will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Service, including any loss arising from a fee payment dispute between a school and a parent. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.
13. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access for breach of these Terms, non-payment, or where required by law. On termination, we will handle any retained data in accordance with our Privacy Policy and applicable law.
14. Changes to These Terms
We may update these Terms from time to time, posting the updated Terms here with a new "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of Kenya. Any disputes arising from these Terms or the Service will be subject to the jurisdiction of the courts of Kenya.
